1. General Provisions↑
The following terms of trade are binding for both the buyer and the seller. The seller and operator of the Internet store, www.64bit.eu, is Stickfish, s.r.o., place of business in Koněvova 141/2660, Prague 3, 130 83, company ID No. 26729687, registered in the Commercial Registry of the Municipal Court in Prague, Section C, Paper 90069, delivery address same as place of business, phone +420 267 108 385, electronic mail address: info@64bit.eu. The buyer indicates their acceptance of the terms of trade by sending an order to the seller.
If the buyer is a physical entity (consumer) buying the goods for other reasons than conducting business, the relations between the seller and the buyer arising from a concluded contract of purchase which are not are governed by these terms of trade are governed by the Civil Code Act. no. 40/1964 Coll., as amended, and the Consumer Protection Act no. 634/1992 Coll., as amended. If the buyer is either a physical entity conducting business or a legal entity buying products for use in conducting their business, the relations which are not governed by these terms of trade are governed by the Commercial Code Act no. 513/1991 Coll., as amended.
Definition of Terms
- A consumer contract is a contract of purchase, contract for work, or other contracts, if the contractual parties are a consumer on one side and a supplier on the other side.
- A seller is an entity acting within the scope of its business or entrepreneurial activity while concluding or fulfilling a contract. It is a businessman who either directly or through other businessmen supplies products to a buyer or provides services.
- A consumer buyer or just consumer is an entity not acting within the scope of its business or other entrepreneurial activity while concluding or fulfilling a contract. It is a physical entity buying products or consuming services for other purposes than conducting business with these products or services.
- A buyer who is not a consumer (hereinafter just “buyer not consumer”) is an entity acting within the scope of its business or other entrepreneurial activity while concluding or fulfilling a contract. It is an entity buying products or consuming services for the purpose of conducting business with these products or services. This buyer is governed by the terms of trade to the extent that applies to them, and by the Commercial Code.
Prices are valid at the time of ordering and are final, i.e, including VAT or other taxes and fees that the consumer must pay in order to acquire the goods. The buyer shall be able to learn how long an offer or a price remains valid before placing an order. Prices of all goods are shown without VAT (VAT is 20%). The price of individual items with VAT and the VAT rate for individual items as well as the overall price of an order and the overall VAT is always shown in the shopping cart before an order is placed and a contract of purchase is concluded. The price shown on www.64bit.eu is valid when an order is placed, the seller does not guarantee its long-term validity. As for costs associated with the delivery of goods, the buyer is obligated to cover expenses corresponding to the price of the delivery of the goods (the price of the delivery of the goods is shown when placing an order).
The seller will not reimburse buyers for any expenses related to the use of means of distance communication without additional expenses. The subject of the contract is only the goods listed in the contract of purchase – order. The seller shall also not be liable for the contents of third party web pages that can be accessed through the 64bit.eu domains or through other domains used by the seller for the purpose of selling goods, nor is the seller responsible for advertisements or other forms of promotion performed through these domains. Following the conclusion of a contract when using means of distance communication, but no later than before commencing fulfillment of the contract, the consumer must be provided with information about post-sale service and warranties, and conditions of withdrawal from the contract if no date of validity is set or if the validity is longer than 1 year.
2. Place of Performance↑
The place of performance is the buyer's address listed in the purchase order and in case of a personal collection of the goods the seller's place of business.
3. Ordering Goods and Contract of Purchase Conclusion↑
The buyer completes an order by sending an order form filled with all particulars and necessary data. If the buyer is a consumer, the contract of purchase is concluded by the buyer – consumer sending their order and the supplier receiving the order. The supplier shall confirm this receipt to the buyer by sending an information e-mail to the buyer's address without delay. This confirmation does not affect the conclusion of the contract. A concluded contract (including the price) may only be changed or canceled on the basis of an agreement between both parties, or for legal reasons. If the buyer is not a consumer, the sending of an order by the buyer constitutes a draft of the contract of purchase, and the contract of purchase itself is concluded when the buyer receives the seller's binding consent with the draft.
Should the seller be unable to deliver the goods ordered by the buyer (for example, because of their long-term unavailability, discontinuance of production, etc.), the seller will inform the buyer of such fact and they will agree on further action (replacement of the ordered goods with something else, cancellation of the order). However, a consumer buyer may demand that the seller fulfills the contract on the basis of the concluded contract. If the buyer agrees with the seller on a different form of fulfillment – goods or procedure, the following applies: if the buyer has already paid for the goods on the basis of an advance invoice and the resulting value of the order after the replacement is lower than the advance payment, the money will be transferred back to the buyer's account within 30 days. If the resulting value of the order after the replacement is higher, the buyer will be charged the difference between the two amounts. If the buyer cancels an order before it is confirmed by the seller, no rights or obligations come into effect between the buyer and the seller. The cancellation of an order must include an unambiguous identification of the particular order, i.e. the order number or its content. The buyer can contact the seller for information regarding the processing and the state of their order using the contact information listed on www.64bit.eu through which the contract of purchase has been concluded.
4. Payment Conditions↑
The method of payment is determined at the time of the confirmation of the order by the seller and in accordance with what is available to and required by the buyer and the seller, and the information provided in the order form.
The goods can be paid for in the following ways:
Advance invoice – a bank transfer from any bank account on the basis of an advance invoice which the seller sends to the buyer's contact e-mail after the order. The order will only be processed after the funds will have been credited to the seller's bank account.
- Cash – a cash payment when collecting the goods personally in the seller's shop, up to EUR 500 without VAT. A cash payment is only possible in the Czech Republic.
- Cash on delivery – a cash payment to the forwarding agent at the time of delivery, up to EUR 500 without VAT. A cash on delivery payment is only possible in the Czech Republic.
- eKonto – payment for clients of Raiffeisenbank, a. s., through a secure interface. Upon completion of an order the buyer is redirected to Raiffeisenbank's payment gateway to pay for the ordered goods.
- Credit Card P – possibility of payment by a VISA or MasterCard payment card through the bank's payment gateway. The payment itself takes place after the completion of an order when the buyer is redirected to the payment gateway.
- PayPal – possibility of payment through the electronic wallet, PayPal. The payment itself takes place after the completion of an order when the buyer is redirected to the PayPal payment gateway.
A prior approval by the seller is required for any other methods of payment. The buyer shall not be charged any fees for using means of distance communication.
5. Delivery Conditions↑
The period of delivery starts on the day following the day of the conclusion of the contract of purchase, provided all details necessary for a timely fulfillment of the order were supplied by the buyer. In case of a payment by an advance invoice the period of delivery starts on the day following the day when the advance invoice was settled, provided all details necessary for a timely fulfillment of the order were supplied by the buyer.
The goods are delivered within the periods specified in individual product descriptions. The seller is, however, not responsible for any potential delays caused by the forwarding agent used by the seller for the actual delivery of goods to consumers. The period of delivery may be clarified at the time of the confirmation of the order on the basis of current stocks in the supplier's or manufacturer's storerooms, but it shall not exceed the periods listed with a particular ordered product.
The bill of delivery and the tax document are delivered to the buyer either with the goods or by mail no later than 14 days after the delivery of the goods. The buyer is obligated to send the signed and confirmed bill of delivery back to the seller by either fax or mail within three days of the delivery of the goods and a completeness check, or within three days of receiving the bill of delivery after the delivery of the goods. If the buyer fails to send the confirmed bill of delivery, the bill of delivery shall be considered confirmed on the tenth day after its delivery to the buyer.
Delivery is handled by DPD, DHL, or TNT or by a different company as specified and agreed upon with the seller's sales agent. Within the CR, DPD usually delivers ordered goods the following business day after the date of shipping, delivery times for foreign countries depend on the distance. The customary delivery time is from 8AM to 3PM on business days. In case you are not found in, the transport company will attempt delivery for the following two days. It is not possible to arrange for a delivery at a certain time.
DPD and other shipping prices:
- If the overall price of the order does not exceed EUR 500 w/o VAT, the cost of delivery is EUR 4 w/o VAT.
- If the order exceeds EUR 500 w/o VAT, delivery is free within the Czech Republic.
- Shipping costs for orders of lower value depend on the delivery address and the weight of the shipped package. Shipping costs for orders to other countries are always shown in the buyer's shopping cart after selecting the target country, and depend on the weight of the transported goods.
6. Rescission of Contract↑
A consumer buyer has the right to withdraw from a contract concluded using means of distance communication within 14 days of taking delivery of the goods. In case the seller failed to provide the consumer with information which they are obligated to provide in writing or in a similar way in accordance with the provisions of §53, paragraphs 4 and 6 of the Civil Code Act no. 40/1964 Coll., the withdrawal period shall be 3 months since the delivery of the goods. However, if the information is properly given during its course, the course of the three-month period shall end and the fourteen-day period shall start from that moment. Apart from cases where the withdrawal right was explicitly agreed on, a consumer can not withdraw, according to the above provisions, from the following contracts:
- for the provision of services if their performance started, with the consumer's consent, before the end of the 14-day period after the acceptance of the performance,
- for the supply of goods or services whose price depends on variations of the financial market and is independent of the supplier's will,
- for the supply of goods modified according to the consumer's request or for their person as well as of quickly perishable goods or goods subject to quick dilapidation, wear or obsolescence,
- for the supply of audio and video records and computer programmes if the consumer disturbed their original manufacturer's packaging, or started to use software for which its manufacturer's conditions stipulate the moment when a software license starts to be used.
7. Electronics Environmental Disposal Fee↑
The final purchase price includes the electronics environmental disposal fee which the producers and the sellers of electronics are required to pay in accordance with Act no. 185/2001 Coll., on waste, as amended. This financial contribution is intended for the recycling of older products. The system's aim is to reduce the amount of electrical and electrotechnical waste. The fee amount is clearly shown no later than before confirming an order.
8. Protection of Personal Information↑
For the purposes of business records, protection of goods and services against misuse, and further cooperation with the buyer, the seller has the right to store personal information about the buyer for as long as necessary. The seller has the right to use and is obligated to administer this information in accordance with Act no. 101/2000 Coll., on protection of personal information, as amended, until the buyer expresses in writing their disapproval of this use. The buyer has the right to access their personal information, the right to have them corrected, as well as other legal rights regarding this information. Personal information can be erased from our database on the basis of a written request by a customer. Personal information of our customers are fully secured from unauthorised use. The supplier does not pass the personal information of its customers on to any other third party, except external forwarding agents who are provided with the least amount of personal information of customers necessary for the delivery of goods. The buyer is entitled to protest in writing any direct marketing use of their personal information.
